Terms of Service

These Terms of Service ("Terms") govern your use of the Magic VPN mobile application ("App") provided by Magic VPN ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 17 years of age and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Description of Service

Magic VPN provides a DNS changing and VPN service for iOS devices. The App allows users to:

• Connect to private DNS servers for enhanced privacy
• Block advertisements, adult content, malware, and other unwanted content
• Adjust user-controlled security levels
• Browse the internet with encrypted connections

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

3. Subscriptions and Payments

3.1 Free and Premium Tiers

The App is available in a free version (with advertisements) and a premium version with the following subscription options:

• Weekly: $3.99 per week
• Monthly: $8.99 per month
• Quarterly: $19.99 every 3 months
• Yearly: $49.99 per year

All prices include applicable local sales taxes and are subject to change.

3.2 Payment and Billing

All payments are processed through Apple's App Store. By subscribing, you authorize Apple to charge the applicable subscription fee to your Apple ID payment method. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

3.3 Cancellation

You may cancel your subscription at any time through your Apple ID Settings:

1. Open the Settings app on your iOS device
2. Tap your Apple ID at the top
3. Tap Subscriptions
4. Select Magic VPN
5. Tap Cancel Subscription

Cancellation takes effect at the end of the current billing period. You will continue to have premium access until that date. No refunds are provided for partial billing periods.

3.4 Free Trials

If a free trial is offered, it will be clearly indicated. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription, and your Apple ID payment method will be charged.

4. Acceptable Use

You agree to use the App only for lawful purposes. You must not:

• Use the App for any illegal activity or to violate any applicable law
• Attempt to gain unauthorized access to the App's systems or networks
• Transmit malware, viruses, or other harmful code through the service
• Interfere with or disrupt the service or servers connected to the service
• Use the App to infringe on the intellectual property rights of others
• Redistribute, sublicense, or resell access to the App
• Reverse engineer, decompile, or disassemble the App
• Use the service for spamming, phishing, or distributing unsolicited communications

We reserve the right to terminate or suspend your access for violation of these terms.

5. Intellectual Property

The App and its original content, features, and functionality are owned by Magic VPN and are protected by international copyright, trademark, patent, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

6. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of any information obtained through the service

7. Limitation of Liability

To the fullest extent permitted by applicable law, Magic VPN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code that may be transmitted through the App

Our total liability for any claims arising from or related to the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Magic VPN and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or violation of these Terms.

9. Third-Party Services

The App may contain links to or integrations with third-party services (including but not limited to Apple services and Google advertising services). We are not responsible for the content, privacy policies, or practices of any third-party services. Your interaction with third-party services is governed by their respective terms and policies.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Magic VPN operates, without regard to its conflict of law provisions.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiations. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration association.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

13. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
